The Ammons Law Firm has successfully negotiated the settlement of a product liability case against Cooper Tire and Ford on behalf of a Texas husband and wife who were seriously injured when their F250 flipped over following a tire failure. While traveling on a Texas highway, the Dominator Sport A/T tire positioned at the left front position of a 2000 Ford F250 failed through tread separation, causing the vehicle to leave its travel lane. The driver applied the brakes and attempted to steer the vehicle back into the lane. The vehicle ignored her steering input, entered the median and then crossed the oncoming traffic lanes as it flipped over twice and came to rest beside the highway. The couple sustained serious injuries.

In their lawsuit, the Plaintiffs alleged that the tire failed because Cooper had built it using belt skim that contained little fatigue resistance and had also failed to include a full nylon cap ply, a safety feature proven to prevent and/or inhibit progression of tread/belt separations.

With respect to the F250, Plaintiffs alleged that Ford had equipped the pickup with a braking system known as “hydroboost.” According to Plaintiffs, in emergency maneuver situations where the operator of a hydroboost-equipped vehicle is compelled to apply the brakes while at the same time inputting significant steer in order to avoid a crash, the system directs a disproportionate amount of available power to the brakes, to the detriment of the steering. The driver in this case found herself behind the useless wheel of a pickup she could not control in a crisis situation. The Plaintiffs additionally contended that the F250 was not crashworthy, since the belted occupants were not coupled to their seats by their restraints during the incident and the air bags failed to deploy.
