Ford Compensates Woman Injured In Rollover of Defective Explorer

The Ammons Law Firm has successfully negotiated the settlement of a personal injury case against Ford on behalf of a 64-year-old Texas woman who was injured when her 1999 Ford Explorer rolled over.

The woman, who was wearing her seat belt, was driving her Explorer home from church when she had to quickly steer to avoid something in the road. The Explorer, which is unstable because of its geometry, skidded across the roadway and rolled over. According to Ammons, the Explorer was not crashworthy in the event of a rollover because its seat belts spool out instead of locking and staying locked during the roll sequence. Additionally, its side windows are made of tempered glass that shatters and vacates window openings in rollovers. The slack in the seat belt, in combination with the ejection portal created by the shattered window glass, allowed the woman’s arm to extend outside the vehicle and interact with the ground as the Explorer rolled. Multiple serious injuries to the arm resulted.

“The importance of containing an occupant completely within a vehicle during a foreseeable rollover crash is something Ford has known about for decades. Selling vehicles equipped with seat belts and side glass that will not provide such containment is unacceptable,” says Ammons.

At Ford’s insistence, the amount of the settlement is confidential.
