The Ammons Law Firm successfully negotiated a $650,000.00 settlement in a wrongful death case filed on behalf of the parents of a 23 year old Houston man who was struck and killed by a Suburban as he crossed the street. The man was survived by his parents.

Shortly after 1:30 a.m., the Suburban was being operated by a 19 year old who, despite not being of legal drinking age, had consumed numerous alcoholic beverages the previous evening. After being involved in that illegal activity, the teen made the decision to drive and, minutes later, drove the SUV into the young man. The teen continued driving after the fatal impact, even while witnesses yelled for her to stop. She eventually pulled into the parking lot of a bank where she phoned her father, informing him that she was too intoxicated to drive. Houston Police arrived shortly thereafter.

In the wrongful death lawsuit Mr. Ammons filed, it was alleged that the teen was negligent in driving while intoxicated, causing the death of the young man. The Suburban was owned by the teen’s parents who, it was further claimed in the lawsuit, were negligent in entrusting the vehicle to their daughter while knowing that she drank alcohol and was going to engage in such behavior during the evening and early morning hours in question. The lawsuit also contained allegations that the parents knew of prescription drugs their daughter was taking that could impair her ability to safely operate a vehicle, especially in combination with alcohol.

“Even under the safest, most benign circumstances, placing machines that weigh several tons in the hands of teenagers can raise safety concerns. Doing so when the teenager is likely to drink before getting behind the wheel is tantamount to handing a kid a loaded gun,” says Ammons.
