April 28, 2011 Houston, Tx: According to the lawsuit filed in Arizona Superior Court, an Arizona woman was driving her Ford Explorer Sport Trac in New Mexico when the left rear wheel Michelin tire experienced a tread separation. As a result of the tread separation failure, control of the Sport Trac was lost and during rollover the woman sustained a serious spinal injury that necessitated emergency surgery and lengthy rehabilitation.
"Michelin knew of this tire's inadequacies," says Rob Ammons in the lawsuit. "But Michelin specifically chose not to warn consumers about them. The tire is defective and unreasonably dangerous and was defectively manufactured and as a result the tire lacked fatigue resistance and had a propensity to suffer tread separation under reasonable and foreseeable operating conditions. Yet, this tire was sold without warning about tire aging and its propensity to detread."
