Nightclub Pays After Fatal Crash Caused by Drunk Teen Patron

The Ammons Law Firm successfully negotiated a cash settlement in a wrongful death case filed on behalf of the parents of a Houston girl killed in an early morning crash. At the insistence of the Defendants, the amount of the settlement is confidential.

The girl was a passenger in a vehicle being operated by a 19 year old who, despite not being of legal drinking age, was served eight drinks at a nightclub on a so-called Minors Night. The nightclub actively courted underage patrons for such nights, which proved popular and were heavily attended.

In the lawsuit Mr. Ammons filed, it was alleged the nightclub’s owners, management and bartenders violated the Dram Shop Act under which bars and other businesses can be held liable when sales to obviously intoxicated persons result in injuries to third parties. Specifically, Ammons’ lawsuit alleged that the nightclub served alcohol to this eventual driver when she was obviously intoxicated and presented a danger to herself and others. The lawsuit also contained allegations that the nightclub was negligent in failing to address and manage the risks involved in allowing underage patrons into the club and ensuring they were not served and overserved alcohol.

“There is no question in the mind of any reasonable person that the club’s employees knew this teenager was intoxicated when they served her. The fact that she was also underage and no one was required or could be bothered to check her identification before serving her alcohol points to just how little they cared about her or anyone else’s safety,” says Ammons.
