Product Defect Attorney Settles Suit Against Ford and Cooper Tire after Fatal Rollover

The Ammons Law Firm has successfully negotiated the settlement of a wrongful death case against Ford and Cooper Tire on behalf of the mother of a 19 year old Texas girl killed in a rollover crash. A settlement was also reached on behalf of the girl’s twin sister who was seriously injured in the crash but survived.

The rollover occurred when a rear tire on a 1997 Mercury Mountaineer experienced a tread separation. The driver was unable to control the vehicle following the tire failure, and it rolled over.
Rob Ammons, who brought a lawsuit against Ford and Cooper Tire on behalf of the surviving twin sister and the grieving mother of the teenager who was killed, claims that Ford had known prior to building the 1997 Mountaineer that its Explorer vehicles (of which the Mountaineer is the Mercury counterpart) handled poorly and were exceedingly difficult to control following failure of a rear tire. Ford also knew that the vehicles were already inherently unstable because of their narrow track width and high center of gravity, making them quite likely to roll over under loss-of-control situations. While Ford knew how to improve both the stability and the handling of the Mountaineer, it chose not to implement such improvements.

The lawsuit also contained allegations that Cooper Tire used improper materials and processes in building the tire and that when it left the factory, there were foreign objects in the tire that prevented its components from properly bonding together. According to Mr. Ammons, the tire was also designed without the durability and safety features necessary to keep its components from separating before the tread had worn out.
