Suit Filed Against Continental Tire and Ford After Tread Separation Causes Fatal Rollover

On behalf of four injured members of a Dallas family and the survivors of a toddler who was killed in a rollover crash, The Ammons Law Firm has filed a lawsuit against Continental Tire and Ford. The family was traveling in a 2003 Ford Expedition when the tread on its right rear tire separated from the carcass. The sudden tire failure sent the SUV out of control, and it rolled over.

The tire was a ContiTrac SUV tire which Rob Ammons claims in the lawsuit was defectively designed and manufactured by Continental. According to Ammons, this crash also happened because Ford designed, manufactured and sold the Expedition, which was prone to oversteer and loss of directional control, especially under sudden tire disablement circumstances. It is contended in the lawsuit that no warnings were given with respect to these handling inadequacies or about the danger of having tires over six years old in service.

Two tire businesses were included in the lawsuit because they provided services involving the Expedition and the ContiTrac SUV without warning that the tire should not be in service due to its advanced age.

“The tire industry just needs to come clean on the tire aging issue,” says Ammons. “They should admit there’s a problem and educate consumers about the issue.”

The Ammons Law Firm has a nationwide personal injury practice focusing on tire defects, truck accidents, rollovers, consumer protection and product liability, catastrophic injury, wrongful death, post-collision fires, seat belt defects, air bag defects and plant explosions.
