Seat belt Defect: Rollover Leads to Latch Plate Failure
Doe, 24, was driving a 2000 Mitsubishi Galant on a highway when the left rear tire failed due to a problem in the road. Doe lost control of the vehicle.
The car rolled over , Doe’s seat belt unlatched, and she was partially ejected form the vehicle. As a result, she was fatally injured. Doe had been a secretary earning about $32,000 annually. She is survived by her husband.
Doe’s husband, individually and on behalf of her estate, sued the vehicle manufacturer, among others, alleging the latch plate on Doe’s end-release seat belt unlatched from the buckle when the vehicle rolled over. Thus, plaintiffs contended, although Doe was belted when the incident occurred, the unlatched belt allowed her to be partially ejected from the car.
