Defective Tire Caused Rollover and Spinal Cord Injury
FACTS & ALLEGATIONS: FACTS & ALLEGATIONS:
On November 20, 2007, plaintiff Heriberto Aguilar Munoz, 20, and plaintiff’s decedent Francisco Aguilar Munoz, 22, both construction workers, were passengers in the back seat of a 1990 Chevy Astro van. The vehicle was traveling north on State Road 91 near Leesburg when the left tire tread separated from the rest of the tire, causing the van to lurch to the left and rollover.
The brothers were both ejected during the rollover and Francisco was killed in the accident.
Heriberto Aguilar Munoz and Genaro Aguilar Mendez, acting as personal representative of Francisco’s estate, sued the tire manufacturer, Bridgestone Firestone North American Tire LLC. They claimed the tire was defectively designed and manufactured.
INJURIES & DAMAGES:
Francisco was ejected from the vehicle and died at the scene. Heriberto suffered a spinal cord injury that has caused paraplegia.
RESULT: The parties settled for a confidential amount.
