Tire Failure Causes Car Rollover and Crash
Doe, 67 and 11 other people were riding in an SUV when the vehicle’s left rear tire, a Uniroyal Tiger Paw XTM P235/75R15, suffered a tread separation. The driver lost control of the vehicle, which rolled over. Doe was ejected and suffered fatal blunt-force head injuries. He has been a subsistence farmer in Mexico and is survived by his wife and three adult children.
Doe’s wife, individually and on behalf of his estate sued the manufacturer of the tire and its affiliated research arm, alleging that the tire had failed due to age related cracking and that defendants had failed to warn of the dangers associated with aging. Specifically, plaintiffs claimed defendants failed to warn that aging and exposure to oxygen, ozone, sunlight and high temperatures can all cause sidewall and tread rubber hardening or cracking, leading to tread separation.
Plaintiffs also alleged the manufacturer failed to indicate the tire’s date of manufacture or an expiration date in a clearly understandable form on the tire.
