Roof Crush Seatbelt Defect Attorney Rob Ammons Wins Settlement After Truck Rollover
July 22, 2011 Houston, Tx.: On June 21, 2008 three people were traveling on a Mexican highway in a 1995 Chevrolet C1500 when suddenly the driver lost control of the pickup and it partially left the roadway. As the driver unsuccessfully attempted to regain the roadway, the C1500 rolled ove r and came to rest on its wheels. During the incident, the roof structure of the C1500 deformed and the side window glazing broke out.
"The crash resulted in the partial ejection from the vehicle and death of the right front passenger, and serious injuries for the right rear passenger," says Houston attorney Rob Ammons .
"The truck's roof, seat belt restraint system and glazing were defective. The roof collapsed and glazing broke out, allowing the right front passenger to be partially ejected from the vehicle and sustain fatal head injuries."
Rob Ammons said the roof with closed header sections, thicker sheet metal or foam filled pillars would have made the pickup's roof strong enough to withstand the rollover. In addition, Ammons claimed the seat belt restraints were not designed to fully and adequately restrain occupants under rollover conditions and that the glazing was made of tempered glass that, when loaded to failure, shattered and ceased to offer support to the roof structure and ceased to provide crucial occupant containment benefits.
The defendants settled with the family of the decedent right front passenger and with the injured right rear passenger for confidential amounts.
