FACTS & ALLEGATIONS:
Doe’s daughter, Priscilla, was driving a 1992 Isuzu Rodeo LS southbound on an interstate highway with Doe, her husband, and their three children as passengers. When she veered onto the shoulder to avoid a deer, the car went out of control, turned counter-clockwise across the southbound lanes of traffic and then turned clockwise into the left northbound lane. The car then rolled over on the driver’s side in the northbound traffic lane.
Doe’s husband, 48 was ejected from the car and died at the scene from blunt head trauma.
Doe, sued Isuzu and the passenger restraint system manufacturer. They claimed the Isuzu Rodeo model was designed unsafely in that its static stability factor (SSF) was 1.076- among the lowest in the industry. This SFF was insufficient to prevent rollover even though the vehicle had not tripped over the road shoulder, plaintiffs asserted, and there was a 30 to 40 percent chance of rollover in the event the car spun out of control in the manner than occurred here.
Plaintiff also asserted the restraint system was defective in the car as the latch plate had separated from the car during the rollover and the latch plate had allowed Doe’s husband to be ejected.
