Houston Trucking Company Pays Mechanic Injured by Big Rig

The Ammons Law Firm successfully negotiated the settlement of a personal injury lawsuit brought by a 61-year-old Texas mechanic injured while servicing an 18-wheeler.

According to the lawsuit, the 18-wheeler’s driver pulled the rig up to an automotive mechanic shop where the mechanic was asked to determine the source of an air leak. In order to do so, the mechanic positioned himself under the 18-wheeler’s passenger side in front of the first set of tandems. While the mechanic was still under the rig, the truck driver re-entered the cab and placed the rig in drive. He moved the truck forward, running over the mechanic’s legs. The mechanic sustained crush injuries and incurred $152,000 in medical charges to treat them.

Rob Ammons alleged in the lawsuit that the driver was negligent in failing to act in a safe and prudent manner at the time of the incident and in violating a Texas law prohibiting movement of a stopped, standing or parked vehicle unless the movement can be made safely. According to the lawsuit, the truck driver was on the job at the time of the incident, making the trucking company for which he worked legally responsible for his negligence. Ammons also claimed that the trucking company was independently negligent because it had failed to properly train and supervise its driver and had failed to establish and enforce adequate safety and accident prevention policies.
